Representing yourself in a court of law is commonly referred to as being “pro se.” Many people choose to represent themselves in court on traffic tickets because they are under the impression that hiring a lawyer will be too costly. However, hiring a lawyer for a traffic ticket in Dallas is much different than hiring a lawyer for a divorce or DWI or any other type of matter. Normally the fees range from $50.00 – $150.00 depending on the matter. However, if you are choosing to represent yourself in court, please make note of the following points listed below. APPEARANCE DATES: Every Dallas traffic ticket comes with an expiration date. If you do not contact the court within 10 – 21 days, that expiration date will pass. Upon the expiration of your appearance date, the court can issue a warrant for your arrest. Don’t miss your appearance date.
ENTERING A PLEA: You have three choices once you contact the court on how to “plea” your case. You can plea (1) guilty (2) no contest or (3) not guilty. Each plea has different ramifications. If you want to set your case for trial and/or have an opportunity to speak with someon other than the window clerk you are going to have to plead “not guilty” and return to court at a later date scheduled by the court clerk. Pleading guilty or no contest at the window waives all opportunity to contest the case or discuss the facts of your case with a prosecutor or judge.
PRE-TRIAL HEARINGS: Your first court date after you plead “not guilty” is usually referred to as a pre-trial hearing. This is your opportunity to review any and all evidence that will be used against you at trial. It is also an opportunity to discuss settlement of your case with the prosecutor to keep the traffic ticket off your record. Some prosecutors are better than others. Many loath pro se litigants and will not help you in any way. Remember that they are not your friends and are not there to help you. Don’t expect them to explain the law and how to get your case dismissed. That is not their job. That is your job. Further, some courts will require a motion to discover any evidence intended to be used at trial. If you do not file this motion, you are not entitled to the information. Be prepared to file the appropriate motions.
TRIAL SETTINGS: Always set your case for a trial before the jury. Judges are many times constrained by finance managers for the city that they work in. If they do not generate revenue, then they put their jobs at risk. Juries are ordinary people who will at least not be biased or intimidated to dismiss a case if it is warranted.
OUTCOME: Be prepared to lose. Set aside enough money to cover a $200.00 fine plus court costs if the jury finds against you. If you win at trial, take the money and spend it on a celebration.
